How to legally transfer state college herbaria to private college?

      A state-owned community college is interested in transferring its 6-cabinet herbarium to our new, small collections at a private, nonprofit college. We are in the same town in Arizona, and their stakeholders are welcomed to visit and use the herbarium after its transfer.

      I provided a donation record (aka Gift of Deed) to the community college, which then brought up the issue that state-owned property is not allowed to be donated.  They suggested they could “loan” it to us, but it seems that would make our organization vulnerable if a future director wanted it back. (Especially after we increased the value of the collection through making it available to research, digitizing the pages, databasing the metadata, etc.)

      Any ideas on forms, wording, laws, etc., that would make this transfer—herbarium cases, too—possible? The intent of the community college is clear—they want us to take over care and curation of the herbarium, indefinitely.
